Voting is February 9 Monday through 24, goes with HOA board member voting, you got an HOA email and you got a paper ballot in the mail earlier this week. If you don’t vote yes, Taylor Morrison gets to keep our money forever!
Below is a smart and concise statement about the HOA lawsuit we have filed and will be voted on.

The most core thing you need to know is that the vote goes the wrong way we are screwed. If somebody said to you that if you pitch in anywhere from $20 to $100 and maybe a little more you would have the chance to benefit in the millions.
- Recover 20 million for poorly engineered roadways you use every day
- Another 4.6M recovered for fees and overcharges that TM has already taken from us
- Places further pressure on TM to transfer ownership on Solivita amenities for a low price or free.
- Return unspent millions in club operating expenses and reserve assessments
And if you don’t spend that little bit of money you would 100% lose the right to any of that!!!
- If the roadways fail, then we would have to pay out of our pockets. That assessment alone will cost each of us thousands of dollars
- The 4.6M that is ours will be lost forever
- TM keeps the amenities forever. They can sell them, make them into a future profit center and do things that will in no way benefit us and that includes millions that they have taken from us to supposedly run the club
Even if your $100 gets us ? of this your small investment will save all of us Millions!
As Brenda said filing the lawsuits puts TM on notice that we are not quitting. They do not want to spend a ton of time and lots of lawyer dollars to continue to defend this. In several cases the law is on our side and they will come to the table to negotiate.

My thoughts shared to all Solivita homeowners about the HOA lawsuit against AV/Taylor Morrison. Please feel free to share this post with your Solivita friends and neighbors. As one of your Class Representatives in the Class Action, as one of the Defendants in the Solivita Bond Validation lawsuit representing all Solivita homeowners, and as a former Solivita HOA Board member, I cannot emphasize enough the importance of the leverage created by the HOA filing the lawsuit. This fight began back in 2015 – 2016, when Avatar Properties tried to sell the Club amenities to the CDDs for $73 M (more like $100 all said and done). Bill Mann and I were the Defendants in that lawsuit representing all homeowners. As a result of that lawsuit, the illegality of the Club Membership Fee came to light. Norm Gundel, Bill Mann, and I picked up the standard for Solivita and continued as 3 lonely homeowners fighting Goliath. The 3 of us got TM to the mediation table but nothing was resolved. We did, however, land a blow by having the Club Membership Fee declared illegal. Yet, it has been a struggle on the turnover of the amenities. The 3 of us now need to pass the standard to the HOA which has the power of almost 10,000 Solivita homeowners. The HOA has far superior standing for the the transition complaints against AV/TM, which should make TM pause to reconsider its legal position should the HOA lawsuit go forward. The HOA Board of Directors needs us, the homeowners, to vote YES in support of the litigation to send a clear and convincing message to TM that we will not be intimidated and we will not back down! Remember, TM did counter sue Norm, Bill and I in the class action, but they cannot intimidate the HOA – all 5000+ homes — if we all stand together. The threat of the HOA’s litigation is, most likely, the only thing that will bring AV/TM to the negotiation table in good faith, which, I believe, is what every Solivita homeowner would prefer. Join the fight, pick up the standard, and help put pressure on AV/Taylor Morrison by voting YES in support of the HOA lawsuit when you receive your ballot. Let’s force AV/TM to the negotiation table and hope that a mutually agreeable resolution will settle all matters without litigation. Thank you for reading and considering this post.
